These Terms of Service ("Terms") are an agreement between you and Medo Ventures LLC ("Medo Ventures," "we," "us"), which owns and operates WattAscent. They cover the WattAscent website at wattascent.com, the WattAscent web, desktop and mobile apps, and related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and confirm you've read our Privacy Policy and Consumer Health Data Privacy Policy. If you don't agree, please don't use the Service.
1. Who can use WattAscent
You must be at least 18 years old and able to enter a binding contract to use the Service. Each account is for one person. Please give us accurate information and keep it up to date.
2. Your account
You sign in with a link sent to your email address. Keep access to that email account secure, because anyone who can open your sign-in links can use your WattAscent account. You're responsible for activity on your account. Tell us right away at hello@medoventures.com if you think someone else has accessed it.
3. Subscription, billing and renewal
- Price. WattAscent costs $99 per year, plus any applicable taxes, billed in advance for each yearly term. Payments are handled by our third-party payment processor; we don't store your full card number.
- Automatic renewal. Your subscription renews automatically each year at the then-current price, using the payment method on file, unless you cancel before the renewal date. We'll email you a reminder before each renewal.
- Cancelling. You can cancel at any time in your account settings or by emailing hello@medoventures.com. Cancelling stops future renewals; you keep access until the end of the year you've paid for.
- Price changes. If the price changes, we'll tell you at least 30 days before it applies to your next renewal, so you can cancel first if you prefer.
- Failed payments. If a renewal payment fails, we may pause your access until payment is updated.
4. 30-day money-back guarantee
If WattAscent isn't for you, email hello@medoventures.com within 30 days of your first subscription payment and we'll refund it in full, no questions asked. Your access ends when the refund is processed. The guarantee applies to your first purchase of a WattAscent subscription. Apart from the guarantee, payments for a yearly term that has started aren't refundable, except where the law requires otherwise or where we end your subscription without cause (see section 12).
5. Health and safety
WattAscent is training software, not medical advice. Talk to a doctor before starting or changing an exercise program, especially if you have a heart condition, high blood pressure, are pregnant, or have any other medical concern.
- Indoor cycling at high intensity carries real risks, including injury, and in rare cases serious heart problems. Stop immediately and seek medical help if you feel chest pain, pressure or tightness, dizziness, faintness, unusual shortness of breath or an irregular heartbeat.
- WattAscent isn't a medical device and doesn't diagnose, treat or monitor any condition. FTP estimates, fitness and fatigue scores, readiness checks and power targets are training estimates. They can be wrong, for example when a sensor reads incorrectly.
- You're always in control of how hard you ride. Ease off or stop whenever you need to, regardless of what a workout or Coach Watson suggests.
- Set up and use your bike, smart trainer and sensors according to their manufacturers' instructions, keep the area around your trainer clear, and stay hydrated and cool.
6. Devices and third-party services
WattAscent works with smart trainers, power meters, heart rate monitors and third-party services such as Strava. Those products and services are run by other companies under their own terms and privacy policies. We're not affiliated with or endorsed by them, and we aren't responsible for their availability, accuracy or how they handle your data.
When you connect Strava, you authorize WattAscent to access your Strava data as described in our Privacy Policy, and, if you choose, to upload your WattAscent rides to Strava. You can disconnect at any time in WattAscent or in your Strava settings.
7. Your data
Your ride data, training history and the other information you add to WattAscent belong to you. You give us permission to store, process and display it only as needed to run, secure and improve the Service for you, as described in our Privacy Policy. You can download or delete your data at any time.
8. Acceptable use
Please don't:
- share your account, or resell or sublicense access to the Service;
- copy, scrape, reverse engineer or try to extract the source code, workout library or training methods behind the Service, except where the law expressly allows it;
- interfere with, overload or try to get around the security of the Service;
- use the Service for anything unlawful, or to infringe anyone else's rights.
9. Our intellectual property
The Service, including its software, workouts, training plans, Coach Watson cues, designs, and the WattAscent name and logos, belongs to Medo Ventures and its licensors. While your subscription is active, we give you a personal, non-transferable, non-exclusive license to use the Service for your own training. Workouts you export (for example, to Zwift) are for your personal use only. If you send us feedback or ideas, we may use them without any obligation to you.
10. Changes to the Service
We're constantly improving WattAscent, so features may change, and we may add, change or remove features over time. Some features may be labeled beta or early access; they may be less reliable. If we make a change that takes away a core part of what you paid for, you can cancel and we'll refund the unused part of your current year.
11. Availability
We work to keep WattAscent running smoothly, but we can't promise it will always be available, uninterrupted or error-free. Maintenance, outages at our providers, device connectivity and internet problems can affect it.
12. Ending your use
You can stop using WattAscent and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these Terms, or if we must to comply with the law. If we close your account without cause, we'll refund the unused part of your current year. Sections 5 and 7 through 17 continue to apply after your account ends.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Training results depend on many things outside our control, so we don't guarantee any particular result, such as a higher FTP, faster times or race performance.
14. Limitation of liability
To the fullest extent permitted by law, Medo Ventures and its members, employees and contractors won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising out of or related to the Service or these Terms. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim arose or $100.
Some places don't allow these limits, so some of them may not apply to you. Nothing in these Terms limits liability that can't be limited by law, such as liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence.
15. Indemnity
If someone brings a claim against us because you broke these Terms or misused the Service, you agree to cover our reasonable costs, including reasonable legal fees, to the extent permitted by law.
16. Governing law and disputes
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. If you have a problem, please email us first at hello@medoventures.com and give us 30 days to try to resolve it informally. Any dispute that can't be resolved that way will be handled in the state or federal courts located in King County, Washington, and you and we agree to their jurisdiction. Either of us may bring an eligible claim in small claims court instead. If you live outside the United States, you may also have rights under the laws of your country that these Terms don't take away.
17. General
- Changes to these Terms. We may update these Terms. If a change is significant, we'll tell you by email or in the app at least 30 days before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
- Entire agreement. These Terms, the Privacy Policy and the Consumer Health Data Privacy Policy are the whole agreement between you and us about the Service.
- Severability and waiver. If part of these Terms can't be enforced, the rest still applies. Not enforcing a right right away doesn't mean we give it up.
- Assignment. You may not transfer these Terms to anyone else. We may transfer them as part of a merger, acquisition or sale of assets, and these Terms will continue to protect you.
